Two consignments arriving at the same Indian port can follow different procedures depending on where they are going. Goods cleared for the domestic market and goods moving through a special economic zone or an export-oriented unit are treated differently, and the difference is decided before the declaration is filed, not after.

Goods for the domestic market

A consignment cleared for home consumption is declared, assessed and released on payment of the duty that applies to it. The importer's registration and the declaration are the same as for any other import; what distinguishes it is that the goods enter the domestic market directly and the duty is discharged at clearance.

Goods moving through a special zone

A special economic zone or an export-oriented unit sits outside the ordinary domestic procedure. Goods moving into, through or out of one follow the requirements that attach to the zone rather than to the domestic market, and the documentation has to reflect that from the outset. Where goods are held in a bonded warehouse rather than cleared, the duty position is different again.

The practical point is that a zone movement is not simply an ordinary import with a different destination address. The procedure, the declaration and the duty treatment are all different, and a declaration filed on the wrong basis is corrected slowly.

Which applies to your consignment

  • Where the goods will finally be used or sold.
  • Whether a special economic zone or an export-oriented unit is involved at any stage.
  • Whether the goods are cleared immediately or held under bond.
  • The port or airport of entry and the route onward from it.
  • Any product-specific permission the goods attract.

Customs is administered centrally

Customs in India is administered centrally, so the requirements follow the goods and the entry route rather than the state they are cleared in. What varies is not the state but the procedure the consignment is entered under, which is why the questions above are the ones that decide the basis.

TCSA reviews the requirement and confirms what is possible, who would carry it out and at what rate before anything is commissioned. Coverage for India is confirmed with your enquiry rather than assumed.
